Refund and Cancellation Policy
CockpitMod d.o.o. | Last updated: 1 August 2024
1. Overview
This Refund and Cancellation Policy describes the conditions under which CockpitMod d.o.o. will issue refunds or cancel subscriptions to Module add-ons purchased through cockpitmod.org. This policy forms part of the Terms of Service and should be read alongside those Terms. If you have questions not addressed here, contact support@cockpitmod.org.
CockpitMod operates on a subscription model: you pay a monthly fee for continued access to each active Module. Because the Modules are software services with no physical component and begin delivering value immediately upon activation, our refund policy is necessarily different from that applicable to physical goods.
2. Cancellation rights
You may cancel any active Module subscription at any time. Cancellation requires 30 calendar days written notice, provided either by email to support@cockpitmod.org or by using the cancellation function in your CockpitMod account dashboard. Cancellation takes effect at the end of the 30-day notice period.
You will continue to have access to the Module during the notice period and will be billed for any complete billing month that begins during the notice period. You will not be billed for any billing month that begins after the effective cancellation date.
Example: if you cancel on 10 March with a 30-day notice period, cancellation is effective on 9 April. If the billing month runs from the 1st, you will receive one final invoice for April (covering 1–9 April, pro-rated) and no further invoices after that.
3. Refunds for billing errors
If you have been incorrectly billed due to a CockpitMod error — for example, if you were charged after a confirmed cancellation date or charged at the wrong rate — CockpitMod will issue a full refund for the incorrectly charged amount within 14 business days of the error being confirmed. To report a billing error contact support@cockpitmod.org with your account email address, the invoice number in question and a description of the discrepancy.
4. Service failures
If a Module is completely unavailable due to a failure on CockpitMod's infrastructure (not due to Dirs21 API issues or Customer-side configuration problems) for more than 72 continuous hours in a billing month, you are entitled to a pro-rated credit for the days of unavailability. Credits are applied to the following month's invoice. Credits are the exclusive remedy for service unavailability and do not constitute a refund of amounts already paid.
5. Dirs21 API changes
Module functionality depends on the Dirs21 API operated by dirs21 GmbH. If dirs21 GmbH makes changes to the Dirs21 API that render a Module unable to function, and CockpitMod is unable to restore Module functionality within 30 calendar days, you are entitled to cancel the affected Module with immediate effect and receive a pro-rated refund for the unused portion of the current billing month. To initiate this process email support@cockpitmod.org with a description of the issue.
6. No cooling-off period for B2B purchases
EU consumer cooling-off rights (typically 14 days for digital services) apply to consumers (private individuals) but not to business customers. If you are purchasing as a business — which is the intended use of CockpitMod add-ons — the 14-day cooling-off right does not apply. Sole traders and self-employed individuals should review their status under the applicable national consumer protection legislation of their country.
7. Data after cancellation
Following cancellation of any Module, your Module-specific data (configurations, processed event logs, historical reports) is retained for 30 days after the effective cancellation date. During this 30-day window you may export your data in CSV or JSON format from your CockpitMod account. After 30 days all Module-specific data is permanently and irreversibly deleted. Your core Dirs21 account, operated by dirs21 GmbH, is not affected by any CockpitMod cancellation.
8. Refund method
All refunds are issued by bank transfer to the bank account from which the original payment was made. If the original payment was made from a different account or if the refund cannot be processed to the original source, CockpitMod will work with you to find an alternative arrangement. Refunds are denominated in EUR. CockpitMod is not responsible for currency conversion costs charged by your bank.
9. Account suspension vs cancellation
If your account is suspended due to non-payment, it is not cancelled. The subscription continues to accrue monthly fees. To cancel a suspended account, you must contact support@cockpitmod.org explicitly requesting cancellation and providing 30 days notice as described in section 2. Outstanding invoices remain payable on cancellation.
10. How to request a refund or cancellation
To request a refund or to cancel a subscription, contact us at support@cockpitmod.org with the following information: your registered email address, the Module you wish to cancel or the refund you are requesting, the reason for the request and, for refunds, the invoice number. We aim to acknowledge all requests within 1 business day and to resolve them within 7 business days.
11. Governing law
This Refund and Cancellation Policy is governed by the laws of Montenegro. Any disputes arising from this policy that cannot be resolved amicably are subject to the jurisdiction of the Osnovni sud u Podgorici.
